COVID-19 AND OUR TERMS AND CONDITIONS AND CANCELLATION POLICY
If you have booked a tour with us or are thinking about booking a tour with us, and you’re concerned about the impact of Covid-19 (Novel Coronavirus) on your travel, please read the following.
In the scheduling and running of our photography tours, we follow guidelines from the destination Governments, airlines and our tour suppliers. However, your decision to travel is personal, and you must base your decision on your circumstances and the information available regarding the impact of Covid-19 on travel. Therefore, ensuring your information comes from a reputable source, including the World Health Organisation, Smartraveller, and the Australian Department of Health (or a relevant website from your own country) is essential.
Cancellation policy if you decide not to travel after booking a tour with us
If you decide to cancel your travel with us because of concerns about Covid-19, you will be subject to the following terms and conditions you agreed upon when you booked and paid your deposit or the total tour balance.
This decision may result in cancellation fees and forfeiture of a proportion of all monies paid, including your deposit. See below to determine the extent of your liability.
You should also consult your travel insurer and their product disclosure statement to determine if you will receive any compensation for cancelling if you fall ill before or during the tour.
What if the tour cannot run because of Covid-19 imposed travel restrictions?
In the case of imposed Covid-19 travel restrictions, our Limitations of Liability in the event of Force Majeure apply (see Terms and Conditions below). In summary, should travel restrictions or snap lockdowns prevent Diana Andersen Photography from delivering all or part of the photography tour, we will refund the customer for the uncompleted portion of the tour, less any reasonable losses incurred before cancellation. In addition, Diana Andersen Photography will use reasonable endeavours to minimise losses incurred by customers.
Note: Any offers of a partial refund or credit note (to be used later) is at the absolute discretion of Diana Andersen Photography. We reserve the right to withhold some monies to cover administrative expenses and other losses, dependent on when the customer gives notice of cancellation.
Photography Tours Terms and Conditions
You must be at least 18 years old and have the authority to accept our terms and conditions on your behalf.
If you book on behalf of other persons, you must be authorised to book for all party members. The booking person must also provide the other party members with a copy of these terms and conditions. Please read the terms and conditions carefully. They apply to all members of your party.
Our confirmation/invoice is acceptance of your booking and confirmation of the travel contract between you and Diana Andersen Photography Tours. Please let us know if any details in the confirmation document require correction within 48 hours of your booking and deposit payment. Otherwise, the details shown in the confirmation document will be presumed to be correct.
Diana Andersen Photography will confirm your booking upon our acceptance of the deposit. We will identify the date for settlement and the final payment in the confirmation document/invoice. If you fail to pay the balance by the deadline, we will cancel your booking and retain the deposit.
For bookings made within 60 days of the tour start date, we require full settlement on booking.
We reserve the right to increase or reduce the tour price if there are significant cost fluctuations and exchange rate fluctuations. We will provide the current price of this tour at the time of booking. While we try to provide reliable information and display correct prices on our website, errors occasionally occur. If we have entered an incorrect price in error, any booking made with this price will not be valid. We will advise you of the mistake at the earliest opportunity. You can either pay the correct price for the booked package or cancel and receive a full refund of any amount you have already paid (see “Cancellations and Refunds” below).
Cancellations and Refunds
You may have to pay a cancellation charge if you cancel your booking. Cancellations must be made in writing or by email by the person who made the original booking and paid the deposit.
You may cancel without penalty if:
- The tour package price increase exceeds 10% due to changes made after the price is initially advertised.
- A major change occurs to the tour itinerary and programme, such as a significant change in the tour dates, the number of days of the tour, or significant changes to the destinations and locations listed in the itinerary. Please note that we do not regard changes in tour accommodation, tour dates changing within 1-3 days, and minor changes to the programmed activities as major changes.
The following cancellation charges apply:
- Deposits are non-refundable. The only exception is if the tour is cancelled by the organisers at least 60 days before the tour date because it has yet to attain the minimum number of guests required for the tour to run, in which case we fully refund deposits.
- If you cancel within 59 and 41 days before departure: 50% of settlement is charged as the cancellation fee.
- If you cancel within 40 and 35 days before departure: 75% of settlement is charged as the cancellation fee.
- If you cancel less than 35 days before departure: 100% of settlement is charged as the cancellation fee (ie. no refund).
We will work out your cancellation charge amount when we receive written notice at our office. You will receive a cancellation invoice upon your request to cancel.
Limitation of Liability
Should the tour itinerary or its features/highlights change, or the tour be cancelled due to circumstances outside of Diana Andersen Photography’s control (including but not limited to war, the threat of war, riots, terrorist activities, civil disturbances, industrial disputes, serious illness, natural and nuclear disasters, adverse weather conditions, hurricanes, floods, unavoidable technical issues with transport, epidemic, pandemic and similar), the organiser will hold no liability towards travellers. The organiser will pay no compensations, payments, expenses or any sums, including the cost of securing alternative accommodation or flights.
If a force majeure event makes it impossible or unsafe for Diana Andersen Photography to deliver all or part of the tour, we may, at our discretion, refund the customer for the uncompleted portion of the tour less reasonable losses incurred before cancellation. In some cases, losses may amount to a substantial proportion of the booking price. Diana Andersen Photography will use reasonable endeavours to minimise losses incurred by customers.
We design our tours for adults of all ages with good to reasonable health and moderate fitness level. Some activities on our tour may require walking and hiking for distances of up to 1 to 5 kilometres on trails, short inclines, and descents. We will identify these activities in the detailed itinerary of the tour. Guests may choose to opt out of such activities at their discretion.
You will need to be able to carry your own camera equipment and water during this tour.
Some tours may require vaccinations. You are responsible for the cost of these vaccinations and must show proof of vaccinations to the tour organiser before the tour’s start date.
You must disclose any medical or physical conditions that may create a risk to you or other tour participants. The organiser assumes no responsibility for your medical care or guarantees meeting your special dietary requirements.
You may only participate in this tour on the provision of your obtaining comprehensive travel insurance for the duration covered by the tour dates, including departure and arrival dates.
When you book to join one of our tours, you accept responsibility for the proper conduct of yourself and your party during your stay. We reserve the right at any time to terminate (before or after departure) your holiday or that of any member of your party due to your or their misconduct. Total cancellation charges in these circumstances will apply, and you will not receive a refund. Furthermore, we shall be under no obligation whatsoever to pay compensation or meet any costs or expenses you may incur as a result of the termination of the booking in accordance with this paragraph. You agree to fully indemnify us against any claim (including legal costs) made by the accommodation or transfer provider for any damage to the accommodation or transport you are using resulting from your actions and caused by you or anyone in your party. You are also liable to make the reimbursement to the accommodation or transfer provider for the damage before the end of your stay.
We will not share with any third parties your personal data (such as your name, contact details, travel preferences and any special needs/disabilities or dietary requirements). However, we will use them for the operational needs related to your purchased tour package. We may also use your email or postal address to send you information and brochures related to our activity; should you wish not to receive these, please inform us upon booking.
